Although the Missouri legislature continues to expand the class of felonies that can be aggravated by prior convictions, at the same time it has passed and the governor has signed into law a statute cited as 610.140, which allows certain charges to be expunged from a criminal record under certain conditions.

What Convictions Can Be Expunged?

DUI expungement is possible under the DUI statute. Section 610.140 now allows expungement of a miscellany of further crimes, including:

  • Certain check-related crimes such as passing bad checks and fraudulent stop payments

  • Crimes such as negligent burning, second-degree tampering, second-degree property damage, and first-degree trespass

  • Gambling

  • Drinking in public

  • Disturbing the peace (Class B and C misdemeanors)

The class of crimes subject to expungement under 610.140 is sure to expand over time.

Certain conditions must be satisfied in order for a crime to be expunged under 610.140. The petitioner must have completed any prison sentence or probation, and not have been arrested for a felony or misdemeanor for 20 years, if the crime to be expunged is a felony; 10 years if it is a misdemeanor. The petitioner must have paid any required restitution, his or her circumstances and behavior must warrant the expungement, and it must be consistent with the general welfare.
